Con el respaldo del Movimiento de Integración y Liberación Homosexual (Movilh), la pareja presentó el recurso en la Corte de Apelaciones y aclaran que, si falla en su contra, acudirán a la Suprema. Además, se anunció una movilización para el 14 de febrero por el matrimonio igualitario.
Ramón Gómez y Gonzalo Velásquez, dos de los cinco autores del bullado libro “Nicolás tiene dos papás”, asistieron hoy a la Corte de Apelaciones para presentar un recurso de protección contra el Registro Civil, luego de que el servicio les negara una hora de matrimonio.
La abogada del Movilh, Mónica Arias, explicó que el recurso se fundamenta en el artículo 5 de la Constitución. Este establece que “Chile está obligado a respetar los tratados internacionales”, como en el caso de la Convención Americana de Derechos Humanos, que ampara el matrimonio entre personas del mismo sexo y que la pareja presentó en el Registro Civil.
Arias añadió que es especialmente relevante el fallo de la Suprema, donde se estableció que “todo habitante de nuestro país tiene derecho a contraer matrimonio” y que lo calificó como un “derecho humano”. La abogada aseguró que si “la Corte de Apelaciones falla contra nuestro recurso, recurriremos a la Corte Suprema”.
En tanto, el vocero del Movilh, Diego Ríos, apuntó que “si bien el fallo de noviembre (de la Corte Suprema) se refiere a una pareja homosexual, todos entendemos que los derechos humanos son universales y que las personas homosexuales son seres humanos”. Además, aseguró que lo que están buscando es “igualdad ante la ley y el acceso al matrimonio”.
La pareja, quienes llevan más de 19 años de relación, explicó que su principal razón para contraer matrimonio es que buscan adoptar y “queremos que nuestro hijo o hija tenga los mismos derechos que otros y no que sea tratado como un niño o niña de segunda categoría, al impedirse jurídicamente el reconocimiento de su verdad, esto es que tendrá dos padres”.
